Florida Attorney General Race Pits James Uthmeier Against Jose Javier Rodriguez

Florida voters will decide on November 3 whether to keep Republican incumbent James Uthmeier in office for a full four-year term as the state’s attorney general or elect Democratic challenger Jose Javier Rodriguez, a former state lawmaker and federal labor official.

The race for one of the state’s top legal and law enforcement positions highlights contrasting visions over public safety, the regulation of technology companies, soaring insurance costs, and the expected degree of political independence for the office.

Uthmeier took over the post in February 2025 after being appointed by Governor Ron DeSantis to fill a vacancy left by former Attorney General Ashley Moody, who stepped down following her appointment to the U.S. Senate. Before heading the attorney general’s office, Uthmeier worked as DeSantis’s chief of staff and general counsel.

His campaign centers on his official record, emphasizing robust support for law enforcement, immigration enforcement, and ongoing investigations into human trafficking and child predators. Uthmeier has also initiated legal actions against technology companies and artificial intelligence platforms over perceived risks to children and consumers, stressing that shielding minors from online exploitation remains a central priority if he secures a full term.

Challenger Jose Javier Rodriguez brings a background as an attorney, former member of both the Florida House and Senate, and a U.S. assistant secretary of labor during the Biden administration. Rodriguez has also worked professionally as a legal aid attorney representing workers.

Rodriguez’s platform is structured around three primary themes: crime, costs, and corruption. On public safety, he has pledged to combat drug trafficking, protect older residents from fraud and abuse, target criminal organizations, and support law enforcement and local prosecutors. Additionally, he has called for more aggressive prosecution of contractor fraud alongside deed and title theft impacting homeowners.

Beyond traditional crime fighting, Rodriguez’s consumer protection agenda targets insurance practices, utility rates, hidden fees, housing costs, and wage theft. He has also promised to investigate potential misuse of public funds and questionable state contracting practices.

A central pillar of the Democratic challenger’s pitch is the argument that the attorney general’s office should function as an independent advocate for everyday Floridians rather than an extension of executive leadership. Rodriguez has frequently criticized Uthmeier’s alignment with the DeSantis administration, asserting that the state’s chief legal officer must place a heavier emphasis on economic affordability and governmental accountability.

While both nominees identify child protection and public safety as core objectives, their broader philosophies diverge on the core mission of the department. Uthmeier emphasizes litigation to enforce state statutes and active involvement in immigration and online safety initiatives, whereas Rodriguez champions economic relief, consumer advocacy, and independent oversight of state government operations.
